1. Acceptance of Terms

Welcome to COA Biohacking Lounge & Clinic ("COA," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and COA governing your access to and use of our services, facilities and website.

By accessing our facility, booking an appointment, using our services or browsing our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

2. Services Offered

COA provides evidence-based biohacking and wellness optimisation services, including but not limited to:

• Hyperbaric Oxygen Therapy (HBOT)
• Infrared Sauna Sessions
• Red Light Therapy (Photobiomodulation)

2.1 Service Descriptions

Service descriptions on our website, marketing materials and verbal communications are for informational purposes and may be subject to change. We reserve the right to modify, suspend or discontinue any service at any time without prior notice.

2.2 Not Medical Treatment

Our services are designed for wellness optimisation and are not intended to diagnose, treat, cure or prevent any disease. They should not replace medical advice or treatment from qualified healthcare professionals. See our Medical Disclaimer for more information.

3. Eligibility and Requirements

3.1 Age Requirements

You must be at least 18 years of age to use our services. Minors under 18 may only use our services with written consent from a parent or legal guardian and must be accompanied by an adult during all sessions.

3.2 Health Screening

All clients must complete a comprehensive health screening questionnaire before using our services. You agree to:

• Provide accurate and complete health information
• Disclose all medical conditions, medications and allergies
• Update your health information if your condition changes
• Inform us immediately of any adverse reactions during or after sessions

3.3 Medical Clearance

For certain services or medical conditions, we may require written clearance from your physician. We reserve the right to refuse service if we determine that a particular therapy may not be appropriate for your health status.

3.4 Contraindications

You acknowledge that certain health conditions may contraindicate specific therapies. It is your responsibility to inform us of any conditions that may affect your ability to safely use our services.

4. Booking and Payment

4.1 Appointments

Appointments can be made through our website, by phone or in person. All appointments are subject to availability and confirmation by COA.

4.2 Pricing

Prices for services are listed on our website and at our facility. Prices are subject to change without notice. The price in effect at the time of booking will apply to your service.

4.3 Payment Methods

We accept payment via:

• Credit and debit cards
• Digital payment platforms (UPI, digital wallets)
• Bank transfers (for packages and memberships)
• Cash (at facility)

4.4 Membership and Packages

Membership and package terms will be outlined in a separate agreement at the time of purchase. Unless otherwise specified, packages are:

• Non-transferable
• Valid for the period specified at purchase
• Non-refundable after 7 days from purchase date
• Subject to availability for booking

4.5 Late Payment

For services requiring prepayment, failure to pay may result in cancellation of your appointment. Outstanding balances may be subject to late fees and collection procedures.

5. Cancellation and Refund Policy

5.1 Cancellation by Client

You may cancel or reschedule appointments subject to the following conditions:

• 24+ hours notice: Full credit toward future services or full refund
• 12-24 hours notice: 50% credit toward future services
• Less than 12 hours notice: No refund or credit
• No-show: Full session charge, no refund or credit

5.2 Cancellation by COA

We reserve the right to cancel appointments due to equipment malfunction, staff illness, emergency situations or other unforeseen circumstances. In such cases, we will:

• Notify you as soon as possible
• Offer to reschedule at no additional charge
• Provide a full refund if rescheduling is not possible

5.3 Refunds

Refunds will be processed to the original payment method within 7-10 business days. Packages and memberships may have different refund terms as specified in your purchase agreement.

6. User Conduct and Facility Rules

6.1 Expected Conduct

While using our facility and services, you agree to:

• Treat staff, other clients and the facility with respect
• Follow all staff instructions regarding equipment use and safety protocols
• Arrive on time for appointments (late arrivals may result in shortened sessions)
• Maintain appropriate hygiene standards
• Keep noise levels to a minimum to respect other clients
• Not use mobile devices in treatment areas unless permitted
• Report any equipment malfunction or safety concerns immediately

6.2 Prohibited Conduct

The following behaviors are strictly prohibited:

• Using services while under the influence of alcohol or recreational drugs
• Harassing, threatening or abusive behavior toward staff or other clients
• Unauthorized photography or recording
• Misuse of equipment or facilities
• Bringing weapons or illegal substances onto the premises
• Violating the privacy of other clients

6.3 Enforcement

Violation of these conduct rules may result in immediate termination of your session without refund, suspension or termination of membership and/or being banned from the facility.

7. Medical Disclaimer and Informed Consent

7.1 No Medical Advice

COA staff, consultants and materials do not provide medical advice, diagnosis or treatment. Our services are complementary wellness protocols and should not replace medical care from licensed physicians.

7.2 Assumption of Risk

You acknowledge and accept that:

• All therapies carry inherent risks
• Results vary by individual and are not guaranteed
• You are responsible for consulting your physician before beginning any new therapy
• You will inform us immediately of any adverse reactions
• You assume all risks associated with using our services

7.3 Waiver and Release

By using our services, you waive and release COA, its owners, employees, contractors and affiliates from any liability for injuries, adverse reactions or other harm arising from your use of our services, except in cases of gross negligence or willful misconduct.

8. Limitation of Liability

8.1 Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will meet your expectations or that they will be uninterrupted, timely, secure or error-free.

8.2 Limitation of Damages

To the fullest extent permitted by law, COA shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or information
• Personal injury (except for gross negligence)
• Emotional distress
• Any other intangible losses

8.3 Maximum Liability

In any case, our total liability to you for all claims arising from your use of our services shall not exceed the amount you paid for services in the 12 months preceding the claim.

8.4 Indemnification

You agree to indemnify and hold harmless COA from any claims, damages, liabilities and expenses (including legal fees) arising from your violation of these Terms or your use of our services.

9. Intellectual Property

9.1 Ownership

All content on our website, marketing materials and facility, including text, graphics, logos, images, protocols and software, is the property of COA or its licensors and is protected by copyright, trademark and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You may not:

• Reproduce, distribute or create derivative works from our content
• Use our protocols or methods for commercial purposes
• Remove or modify any copyright or trademark notices
• Reverse engineer or decompile any software or systems

9.3 Trademarks

"COA," our logo and other marks are trademarks of COA Biohacking Lounge & Clinic. You may not use these marks without our prior written permission.

10. Termination

10.1 Termination by You

You may terminate your relationship with COA at any time by ceasing to use our services and closing your account (if applicable). Memberships and packages may have specific termination terms.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Behavior that endangers staff or other clients
• Non-payment of fees
• Any other reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect, including liability limitations, indemnification and dispute resolution.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the jurisdiction of Maharashtra, without regard to conflict of law principles.

11.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of our services:

• Informal Resolution: You agree to first contact us to attempt to resolve the dispute informally
• Mediation: If informal resolution fails, both parties agree to attempt mediation before pursuing litigation
• Arbitration: Disputes that cannot be resolved through mediation may be submitted to binding arbitration in Pune, Maharashtra

11.3 Jurisdiction

You agree that the courts of Pune, Maharashtra shall have exclusive jurisdiction over any legal proceedings arising from these Terms.

11.4 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions or class-wide arbitration.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and COA regarding your use of our services.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, government actions, wars, pandemics, or other force majeure events.
